$2+ Million Unanimous Verdict Upheld

PHILADELPHIA (October 20, 2011) –  A unanimous jury verdict awarding $2,154,583.73 in damages to the family of a child who sustained a devastating brain injury just before his delayed delivery at the  Hospital of the University of Pennsylvania was confirmed Tuesday with the issuance of an Order denying the Motion for Post Trial Relief filed by defendant obstetrician  Peter Chen, M.D. and defendant Hospital of the University of Pennsylvania, which included a request for new trial.

The Honorable Frederica A. Massiah-Jackson of the Court of Common Pleas of Philadelphia County, Pennsylvania also granted the Plaintiffs’ Motion for Delay Damages awarding Kyra Hatwood and David Jacobs, parents and Co-Administrators of the Estate of Hyseem Jacobs, bringing the total damages awarded to $2,297,583.81.

In February, a unanimous Philadelphia jury found that the Defendants provided sub-standard care to Kyra Hatwood and her child Hyseem Jacobs during the course of labor and delivery on March 22, 2006. The hospital and physicians delayed in performing a Cesarean section delivery. The child sustained a 15 to 20 minute period of severe oxygen deprivation just before delivery, secondary to placental abruption, while under the care of Dr. Chen and HUP, causing what doctors described as a devastating injury to Hyseem’s brain.

As a result of the brain damage, Hyseem Jacobs was completely disabled from birth, unable to move, hold his up, cry, speak or feed himself.  He lived with and was cared for by his family until he died as a result of complications of cerebral palsy on August 25, 2007.
