Philadelphia Product Liability Attorneys: Beware of Defective Inflatable Water Slides

Risk of Serious Injury and Death Force Recall of Defective Banzai Water Slides

The United States Consumer Product Safety Commission (CPSC) issued a recall last week of about 21,000 of the Banzai Falls In-Ground Pool Slide, a large inflatable slide that is intended to be set up at the edge of an in ground pool.  Consumers are recommended to stop using this dangerous product immediately.

An investigation by the CPSC found that the slide has serious design defects.  The defective slide can deflate near the bottom causing users to hit the surface underneath the slide.  The agency also discovered that the slide is unstable adding the risk of the slide tipping over.  The risk of serious bodily injury or death exists.  In addition, the slide is sold with inadequate warnings and user instructions.

Defective Product Results in One Fatality and Serious Neck Injuries

According to complaints filed with the CPSC, one fatal injury has been reported as a result of the defective product.  A young mother from Colorado died from a fractured neck injury after she hit her head on the concrete surface beneath the partially deflated slide.  Her lawsuit resulted in a $20 million dollar verdict.  Two additional injuries of a similar nature have been reported.  One victim is a 24-year-old man who hit his head while sliding down and became a quadriplegic. Another woman from Pennsylvania fractured her neck, but survived.

Manley Toys, Ltd in China manufactured the defective slide sold across the country at Toys R Us and Wal-Mart from January 2005 through June 2009.  Although the original packaging contains the model number of 15734 and a barcode number of 2675315734, the slide itself does not have a model number printed directly on it.  The slide can be identified by its blue base and yellow sliding mat with an arch over the top and the logo “Banzai Splash” appears on both sides of the 6-foot slide.  Again, the CPSC urges owners of the recalled product to discontinue its use.  Consumers are advised to return the slide or the two warning labels that are on the slide to the retailers mentioned above for a full refund.
