COURT DENIES 3M’s MOTIONS FOR REMITTITUR, NEW TRIAL, AND JUDGMENT AS MATTER OF LAW. $50 MILLION VERDICT FOR LUKE VILSMEYER STANDS.

Judge Roy B. Dalton Jr., who presided over the Luke Vilsmeyer v. 3M trial in March of this year, just issued his Orders on Defendants’ post-trial motions, denying Defendants’ motions for including a new trial/remittitur and for judgment as a matter of law.

Plaintiff’s trial team, including Joseph L. Messa, Jr. and Ashley B. DiLiberto of Messa & Associates, P.C. provided the jury with ample evidence during trial to support the Jury’s $50 million compensatory damages award. Judge Dalton wrote, “the record substantially supports that Plaintiff’s tinnitus in particular is in fact…severe and constant…and permanent,” that “Plaintiff’s testimony was extremely effective and compelling in demonstrating the significant emotional impact that the tinnitus had on his life…” and that “even defense counsel could not help but acknowledge plaintiff’s credibility and…truthfulness.” Judge Dalton ruled that “the Court will not disturb the jury’s evaluation of the Plaintiff’s testimony and the noneconomic damages caused by his injuries, which are substantially supported.”

Joseph L. Messa, Jr. states “The denial validates the significance of the jury’s verdict. This determination verifies that 3M’s conduct cannot be defended after knowingly selling defective hearing protection that our soldiers rely on for the sake of company profit.” Ashley DiLiberto adds “These orders confirm that the jury fully recognized the devastating impact Luke Vilsmeyer’s injuries had on him and his family and that the jury’s well-reasoned verdict, which is substantially supported by the record, must stand.”
