  • Medical Malpractice Lawyers: Family Wins $21 Million Verdict in Birth Injury Case

Medical malpractice lawyers won the family of a now 9-year-old boy born with cerebral palsy a $21 million verdict in Baltimore last week. Jaylan Norfleet was born prematurely and lost oxygen while still in his mother’s womb. Attorneys for the family argued that medical providers at the hospital should have performed a Caesarean section rather than allowed a prolonged vaginal birth. The verdict is the second largest medical malpractice verdict to be awarded in Baltimore this summer.

Jaylan was born in 2002 at Harbor Hospital. The boy has very limited use of his legs and trouble completing specific tasks with his hands, such as writing. He is fully functioning cognitively, but his body is severely disabled as a result of cerebral palsy. The family was awarded $18 million for his medical care, $2 million for lost potential wages, and $1 million for noneconomic pain and suffering.

In June, the family of 2-year-old Enzo Martinez won a $55 million verdict against Johns Hopkins Hospital for a birth injury case. Enso also suffers from cerebral palsy as a result of a delayed Caesarean section which caused a loss of oxygen to his brain.

Medical Malpractice Lawyers: Cerebral Palsy, Other Birth Injuries are Often the Result of Delayed Delivery

Delayed delivery, failure to take precautions during a high-risk pregnancy, and other medical errors before or during birth can result in serious birth injuries. Permanent birth injuries may include cerebral palsy, bleeding in the brain, skull fractures and spinal damage. Medical professionals are responsible for providing prompt and appropriate treatment to avoid injuries that could cause further complications, birth injuries or death.

In medical malpractice cases involving prenatal care or child birth, failure of a medical professional to act in accordance with the accepted standard of care could result in costly and devastating injuries to mothers and their babies. In these cases, families may be able to recover damages for future medical costs and other expenses they will incur in the future.
