  • Family Awarded Damages in Dram Shop Case

Personal injury attorneys in Dallas won the family of Kasey McKenzie a $10.5 million verdict earlier this week. The 23-year-old woman was killed after she was run over by a monster truck in the parking lot of a strip club in March 2011.

The driver of the truck, Eric Crutchfield, had consumed more than 10 alcoholic drinks and shots before leaving the Spearmint Rhino. Crutchfield was at the club for about four hours and continued to be served although he was visibly intoxicated, according to video evidence presented in court. When he exited the club, his blood alcohol level was more than twice the legal limit and he got into his truck, running over Kasey in the parking lot.

Crutchfield was convicted on a manslaughter charge and is currently serving nine years in prison for the death of the 23-year-old girl.

Personal Injury Lawyers Discuss Liquor Liability Laws, Who’s Responsible After an Alcohol-Related Injury

Dram shop/liquor liability laws hold businesses including bars, clubs, liquor stores and restaurants as well as private events responsible for alcohol-related injuries when they serve alcohol to someone who is already visibly intoxicated or underage and that person later breaks the law or is involved in an accident that injures themselves or others.

Although dram shop laws vary from state to state, many states including Pennsylvania hold a business or individual who provides the alcohol to a visibly intoxicated individual legally liable for any damage that person causes. Victims who from suffer alcohol-related injuries may in turn bring a civil suit against the individual or business who served the alcohol.
