  • Personal Injury Attorneys and Boston Scientific Meet in Federal Court Over Transvaginal Mesh Injuries

One is in Charleston, WV and involves allegations from four women over the Obtryx vaginal mesh device, used to treat stress urinary incontinence. The other trial is in Miami and involves women implanted with the Pinnacle vaginal mesh device which treats pelvic organ prolapse.

Concerns were first raised publicly about transvaginal mesh products six years ago. Since then, Boston Scientific has been nailed with more than 23,000 suits in U.S. state and federal courts. Federal cases against Boston Scientific and six other companies have been consolidated before U.S. District Judge Joseph Goodwin in the Southern District of West Virginia.

Failure of Vaginal Mesh Devices Forces Record-Breaking Number of Lawsuits

Transvaginal mesh has become one of the most sued over medical devices in history. Judge Goodwin has said he will resort to creative tactics, such as grouping like plaintiffs together, in an attempt to keep the litigation from dragging on for decades. That won’t be easy given that the three biggest defendants, Boston Scientific, Johnson & Johnson’s Ethicon Inc unit, and C.R. Bard, Inc, face more than 72,000 claims in federal and state courts.

In April, the U.S. Food and Drug Administration (FDA) said it was considering requiring the makers of products used to treat pelvic organ prolapse to submit additional safety data to remain on the market. Plaintiffs and personal injury attorneys say the transvaginal mesh devices were poorly designed, made from substandard material and can lead to injuries ranging from infection and pain to bleeding and nerve damage.
