  • Tylenol Cases to be Heard Before U.S. Eastern District of Pennsylvania Judge

philadelphia personal injury lawyers | new jersey personal injury lawyersPersonal injury lawyers announce that the U.S. Judicial Panel on Multidistrict Litigation has approved the consolidation of 27 cases against drug makers McNeil/Johnson & Johnson, Novartis, and L. Perrigo Co. involving the use of over-the-counter Tylenol. U.S. District Judge Lawrence F. Stengel of the Eastern District of Pennsylvania will hear the cases of plaintiffs who allege that Tylenol is responsible for liver injuries they suffered after taking the drug. According to lawsuits filed on behalf of the plaintiffs, McNeil failed to properly warn its consumers of the risks of liver toxicity associated with Tylenol.

The 27 pending cases were consolidated based on their common issues and allegations made by the plaintiffs. An order issued by the panel stated, “The actions all involve allegations that ingesting acetaminophen — specifically, OTC Tylenol in its various forms — can cause liver injury. The actions share factual issues concerning the design, manufacture, labeling, marketing, and sale of Tylenol.”

Judge Stengel has already been assigned the federal cases in Pennsylvania.

The personal injury lawyers at Messa & Associates have filed three lawsuits involving children who ingested Tylenol and later died. Tylenol contains the active ingredient acetaminophen which has the potential to cause liver damage and even death when taken in large doses. Acetaminophen causes three times as many cases of liver failure as all other drugs combined, and is the most common cause of acute liver failure in the United States. The cases were all filed in Philadelphia Court of Common Pleas.
