  • Personal Injury Lawyers Alarmed by Recent Injuries to Children in Area Daycare Centers

Philadelphia personal injury lawyers at Messa & Associates recently learned that daycare workers at two separate facilities have been arrested in the past week for incidents involving injuries to children or child welfare endangerment. On Monday, three daycare workers in Delaware were arrested after video of women surfaced showing them encouraging toddlers to fight each other. The video was taken by one of the women who were arrested. All three women have been charged with second-degree assault, endangering the welfare of a child, and other offenses. The daycare’s license has been suspended.

In another accident in Jersey City, N.J., a female daycare employee was arrested and charged with breaking the leg of a 4-month-old boy while he was under her care. According to investigators, the woman injured the child’s tibia with her hand. Following her arrest, the daycare was inspected and cited for numerous health and fire-related code violations. The 19-year-old worker was charged with aggravated assault, child abuse and endangering the welfare of a child for “failing to seek medical treatment for the victim.”

Daycares Responsible for Supervising Employees, Preventing Injuries to Children

Many injuries to children while they are in daycare centers are caused or worsened as a result of poor supervision and/or the facility’s failure to hire qualified staff members. In these cases, the daycare may be held liable for injuries to children as a result of a staff member’s negligence. Daycare centers have a responsibility to properly examine the background and qualifications of all employees and provide proper training in order to ensure the safety of the children for whom they are caring. Likewise, employees are expected to follow all safety guidelines and protocol set forth by the state and daycare where they are employed.

The attorneys at Messa & Associates have pursued cases involving injuries and death of children in daycares. We have obtained verdicts and settlements for families, including a $5.75 million settlement awarded to the family of a 2-year-old child who died at a daycare while being improperly supervised by her caregivers.
