Earlier today, Philadelphia Court of Common Pleas Judge Kevin Dougherty ordered the organization of a mass tort against Janssen Pharmaceuticals (Johnson & Johnson subsidiary) and Bayer Healthcare Pharmaceuticals regarding the drug Xarelto; an anticoagulant, or blood thinner, that is accused of causing uncontrollable and sometimes fatal bleeding.

Approximately seventy-five cases were transferred to the Philadelphia Court to be heard on behalf of victims of Xarelto. A complaint filed against Janssen in the Philadelphia Court of Common Pleas just a few months ago alleges that the pharmaceutical giant negligently advertised and marketed the drug, paying no regard for the accuracy of their claims or the consequences of misrepresentation. The plaintiff of the case, Della Wise, filed the claim on behalf of her deceased aunt, Maggie Edgin, who’s death was caused by Xarelto, the complaint alleges.

The complaint goes on to state,

“Due to the defective nature of Xarelto, persons who were prescribed and ingested Xarelto, for even a brief period of time, including the Ingesting Decedent herein, were at increased risk for developing life-threatening bleeds. Due to the flawed formulation of Xarelto, which according to defendants does not require regular blood monitoring or frequent doctor follow-up, raises concerns about the risk of stroke, bleeding, and blood clots if not taken properly or absorbed properly, particularly in patients with poor renal function.”

Wise is seeking punitive damages from the makers of Xarelto for fraud, wrongful death,consumer law violations, negligence, failure to warn, product liability, unreasonable marketing of a dangerous drug, and breach of warranty. It is unclear if her case counts among the seventy-five ordered to be included in the mass tort.

Bayer did not offer any statements regarding the great news for claimants, however a Janssen spokesperson offered a short statement in an e-mail to The Legal Intelligencer, saying, “We will defend ourselves against the claims raised in this litigation.”
